Privacy Policy of Clarity Edit

This Privacy Policy explains how Clarity Edit (“Clarity Edit,” “we,” “us,” or “our”) collects, uses, stores, shares, and protects personal data when you visit https://www.clarityedit.com/, contact us, request a quote or free trial, submit files, place an order, or otherwise use our photo-editing services.

This Policy is a privacy notice. It does not replace any consent or other legal basis required under applicable law.

1. Who We Are and Our Role

Clarity Edit provides human-led photo-editing services to photographers, ecommerce businesses, agencies, brands, and other clients worldwide.

For personal data used to operate our Website, respond to inquiries, manage orders, issue invoices, communicate with clients, and maintain business records, Clarity Edit normally acts as the data controller or responsible business.

When a business client submits images or files containing personal data about customers, models, employees, or other individuals and we process those files solely according to the client’s instructions, Clarity Edit normally acts as a data processor or service provider. In that situation, the client remains responsible for ensuring that it has the necessary rights, notices, permissions, consents, and other lawful grounds for the processing.

2. Personal Data We Collect

Depending on how you interact with us, we may collect the following categories of personal data.

A. Contact and Identity Information

This may include:

  • Name;
  • Email address;
  • Telephone number;
  • Street or billing address;
  • Company or business name;
  • Website address; and
  • Other contact details you voluntarily provide.

B. Inquiry, Quote, and Order Information

This may include:

  • Services requested;
  • Image quantity;
  • Project requirements and editing instructions;
  • Requested turnaround time;
  • Messages, feedback, and revision requests;
  • Quote and order confirmations;
  • Records showing acceptance of applicable terms or instructions; and
  • Communications relating to support, cancellation, disputes, or service quality.

C. Images and Project Files

This may include:

  • Sample images submitted for a quote or free trial;
  • Original images;
  • Edited images and Deliverables;
  • Working files;
  • File names, formats, links, and associated metadata;
  • Reference materials and project guidelines; and
  • Feedback, annotations, and revision notes.

Images may contain personal data about people other than the person submitting the files. Section 10 explains the client’s responsibilities when submitting such material.

D. Payment and Transaction Information

Payment instructions are provided in your quote or invoice. This Website does not collect or store full payment-card numbers.

Depending on the payment method used, we may receive limited transaction information such as:

  • Payer name;
  • Billing or contact details;
  • Amount and currency;
  • Payment date;
  • Transaction or reference number; and
  • Payment, refund, or dispute status.

Banks and payment-service providers process payment credentials under their own privacy notices and security arrangements.

E. Website, Device, and Usage Information

When you visit the Website, we or our service providers may receive:

  • Internet Protocol address;
  • Browser and device type;
  • Operating system;
  • Approximate location derived from an Internet Protocol address;
  • Referring page or source;
  • Pages visited and approximate visit times;
  • Website interactions;
  • Cookie-consent choices; and
  • Technical, security, spam-prevention, and error-log information.

Optional analytics information is collected only according to the cookie choices described in Section 6.

F. Testimonials and Permissions

If you voluntarily provide a testimonial or give written permission for us to display particular work, we may retain the testimonial, permission record, approved name, company information, and specifically approved project material.

3. Where We Obtain Personal Data

We may obtain personal data:

  • Directly from you through our Website, forms, email, telephone, or other communications;
  • From your employer, agency, photographer, or another authorised project contact;
  • From images, documents, instructions, or file-transfer links submitted by a client;
  • Automatically from your browser or device, subject to applicable cookie choices; and
  • From a bank or payment provider in connection with a payment, refund, or transaction inquiry.

We do not purchase contact lists or use inquiry or order details to create marketing lists.

4. How We Use Personal Data

We use personal data only for relevant business and service purposes, including:

  • Reviewing inquiries and providing quotes;
  • Assessing free-trial submissions;
  • Confirming project requirements;
  • Performing the requested editing services;
  • Conducting quality checks;
  • Delivering completed files;
  • Managing revisions and client support;
  • Processing and confirming payments or refunds;
  • Maintaining invoices and necessary business records;
  • Protecting the Website, forms, files, clients, and our team from fraud, spam, abuse, or unauthorised access;
  • Enforcing contracts and handling complaints or legal claims;
  • Complying with legal, tax, accounting, regulatory, or court requirements;
  • Maintaining and improving Website performance; and
  • Measuring Website use through Google Analytics 4 when the visitor has provided the required analytics consent.

We do not currently use quote, inquiry, or order contact details to send promotional email, SMS, WhatsApp messages, or similar direct-marketing communications.

We do not sell personal data or client images. We do not share personal data for cross-context behavioural advertising.

We do not use personal data to make solely automated decisions that produce legal or similarly significant effects.

Where a law such as the European Union General Data Protection Regulation or United Kingdom General Data Protection Regulation requires us to identify a legal basis, we rely on the basis appropriate to the particular activity.

These may include:

  • Contract and pre-contractual steps: To respond to a requested quote, manage an Order, edit and deliver files, provide revisions, and process related communications.
  • Legal obligation: To maintain records or disclose information when required by applicable tax, accounting, regulatory, or other law.
  • Legitimate interests: To operate and secure the Website, prevent fraud and misuse, maintain proportionate business records, improve service quality, and establish, exercise, or defend legal claims, provided those interests are not overridden by the individual’s rights.
  • Consent: For optional analytics cookies and for any separately approved testimonial, portfolio, or promotional use of identifiable project material.
  • Other lawful grounds: Where another lawful basis or condition is available under applicable law.

You may withdraw consent at any time. Withdrawal does not affect processing that was lawful before consent was withdrawn.

When project files contain sensitive or specially protected personal data, the client submitting the files is responsible for ensuring that an appropriate legal basis and any additional required condition are in place.

6. Cookies and Google Analytics

The Website may use strictly necessary cookies or similar technologies for functions such as:

  • Website security;
  • Spam and abuse prevention;
  • Form operation;
  • Remembering cookie choices; and
  • Maintaining essential Website functionality.

These technologies may operate without optional analytics consent where permitted by law because they are necessary for the Website to function securely.

We also use Google Analytics 4 to understand, in aggregate, how visitors find and use the Website. Analytics may process information such as pages visited, approximate location, browser or device information, referral source, visit duration, and Website interactions.

Google Analytics is configured to operate according to the visitor’s analytics-cookie choice. Optional analytics storage is not activated until the visitor provides the applicable consent through our cookie notice.

We do not intend to send names, email addresses, telephone numbers, uploaded images, payment credentials, or project instructions to Google Analytics.

You may reject analytics cookies without preventing access to the main Website. To withdraw a previous choice, use the Website’s available cookie control or clear cookies for clarityedit.com and revisit the Website.

A. Bangladesh Staff and Local Contractors

Authorised Clarity Edit staff and local contractors in Bangladesh may access the project information and files required to review, edit, quality-check, deliver, or support an Order.

Access is limited according to work responsibilities and need. Staff and contractors are subject to confidentiality and data-handling obligations and are not permitted to use client files for their own purposes.

B. Technology and Business Service Providers

We may use providers that support:

  • Website hosting and content delivery;
  • Website security and spam prevention;
  • Email and business communications;
  • File storage, backup, or transfer;
  • Form processing;
  • Google Analytics;
  • Invoicing and record management; and
  • Payment or banking services.

These providers may process only the information necessary to provide their relevant service.

C. Client-Selected Transfer Services

If you submit files or links through services such as Google Drive, Dropbox, WeTransfer, or another transfer platform, that provider processes information under its own privacy policy. You should review the provider’s terms before uploading sensitive material.

D. Professional Advisers and Authorities

We may disclose relevant information to accountants, legal advisers, insurers, regulators, courts, law-enforcement authorities, or other authorised parties where reasonably necessary to:

  • Comply with law or a valid legal process;
  • Protect legal rights;
  • Prevent fraud or serious misuse;
  • Resolve a dispute; or
  • Establish, exercise, or defend a legal claim.

We do not rent, trade, or sell client contact details or project files.

8. International Processing and Transfers

Clarity Edit is based in Bangladesh. Our authorised staff and local contractors access and process project information in Bangladesh.

If you are located outside Bangladesh and submit personal data to us, that data will be transferred to and processed in Bangladesh. Some Website, analytics, email, payment, hosting, or file-transfer providers may also process information in other countries.

Where applicable law requires a particular international-transfer safeguard, we will use or enter into an appropriate contractual or other lawful mechanism. This may include approved standard contractual clauses, United Kingdom transfer terms, a data-processing agreement, or another safeguard recognised by the relevant law.

Business clients requiring specific data-processing or international-transfer terms should contact us before submitting regulated or sensitive personal data. You may also contact us for further information about applicable transfer safeguards.

9. Data Retention

We retain personal data only for the relevant purpose and for any period reasonably required by applicable law, accounting requirements, dispute-resolution needs, or legal claims.

Project and Image Files

Original images, edited images, working files, project instructions, and revision materials are normally retained for 90 calendar days after Final Delivery.

This period allows time for the client to download files, identify delivery issues, and request eligible revisions.

If a quote or free-trial request does not proceed to a paid Order, submitted samples and related working files are normally deleted within 90 calendar days after the request is closed or the last substantive project communication.

Clients should download and securely store their Deliverables before the applicable 90-day period expires. Clarity Edit is not a permanent file-storage or backup service.

A client may request earlier deletion. Early deletion may prevent further redelivery, revision, or investigation of the affected project.

After the applicable period:

  • Files are removed from active project storage in the ordinary course;
  • Staff and contractor access is withdrawn when no longer needed; and
  • Any residual copies in routine backups may remain temporarily until those backups are overwritten or deleted under the applicable backup cycle.

Residual backup copies are not used for new or unrelated purposes.

Communications and Business Records

Inquiry, quote, order, delivery, support, and complaint records are retained while the matter is active and afterward only for proportionate client-service, contractual, security, dispute, and legal-record purposes. They are deleted or anonymised when those purposes no longer require them.

Payment and Accounting Records

Invoices, transaction references, refund records, and related accounting information may be retained for the period required by applicable tax, accounting, anti-fraud, or legal obligations.

Analytics and Cookie Information

Google Analytics user-level and event-level data is retained for no longer than 14 months under the applicable Analytics property setting. Aggregate reports that do not directly identify an individual may be retained for longer.

Cookie-choice information remains until the relevant cookie expires, is replaced, or is cleared from the visitor’s browser.

Legal or Security Exceptions

We may retain limited information for longer where reasonably required by law, a legal hold, fraud investigation, payment dispute, court proceeding, or the establishment, exercise, or defence of a legal claim. The information will be deleted or anonymised when the exception no longer applies.

10. Client Responsibilities for Images of Other People

If you submit an image, file, or instruction containing personal data about another person, you confirm that you are authorised to submit it and instruct us to process it.

You are responsible for:

  • Having an appropriate lawful basis;
  • Providing any privacy notice required to the people concerned;
  • Obtaining consent where consent is required;
  • Respecting copyright, image, publicity, and privacy rights;
  • Limiting the submitted information to what is necessary; and
  • Avoiding unnecessary sensitive information.

Unless specifically required for the agreed service, do not submit government identification numbers, account passwords, full payment-card details, medical records, or other highly sensitive information.

If you submit images of children, you must have the authority and any permission required to submit and edit those images.

Where we process files solely on behalf of a business client, a person shown in those files should normally direct a privacy request to that client. We will reasonably assist the client with eligible requests where required.

11. Portfolio, Testimonials, and Public Use

We will not publish identifiable client images, private project files, or testimonials for portfolio or promotional use without separate permission.

Any permission request will identify the material and intended use. Refusing permission will not affect the requested editing service.

You may withdraw permission for future use by contacting us. We will take reasonable steps to remove the material from locations under our control, although withdrawal does not make earlier lawful processing invalid and may not remove copies already printed, shared, indexed, or stored by independent third parties.

12. Data Security and Confidentiality

We use reasonable technical and organisational measures appropriate to the nature of the information we handle. These may include:

  • Need-to-know access restrictions;
  • Account and access controls;
  • Confidentiality obligations for staff and contractors;
  • Secure transfer methods where available;
  • Service-provider assessment;
  • Website security and spam-prevention controls; and
  • Procedures for responding to suspected security incidents.

No Internet transmission, storage system, or security measure can guarantee absolute security. If we become aware of a personal-data breach, we will investigate and provide any notification required by applicable law.

  • Request access to your personal data;
  • Request correction of inaccurate or incomplete information;

We may request reasonable information to verify your identity, authority, and connection to the relevant data. We will respond within the period required by applicable law.

We do not discriminate against individuals for exercising an eligible privacy right.

Clarity Edit does not sell personal information or share it for cross-context behavioural advertising.

14. Children’s Privacy

Our Website and ordering services are not directed to children acting independently.

A person who is not legally able to enter into a service contract should use the Website or Services only through an authorised parent or legal guardian.

We do not knowingly use children’s contact information for marketing. If you believe a child has directly submitted personal data without appropriate authority, contact us so that we can investigate and take appropriate action.

This section does not prevent an authorised adult or business client from submitting a child’s image for a legitimate editing service where the required rights and permissions are in place.

Our Website may link to third-party websites, payment services, social platforms, or file-transfer services.

Those organisations operate under their own privacy policies. Clarity Edit is not responsible for an independent third party’s privacy practices, security, or content. Review the relevant provider’s privacy information before submitting personal data through its service.
