Terms and Conditions – Clarity Edit

Welcome to Clarity Edit (“Company,” “we,” “us,” “our”). These Terms and Conditions govern your use of our website https://www.clarityedit.com/ (“Website”) and all photo editing services, free trials, quotes, and deliverables we offer (“Service”).
By accessing our Website or placing an order, you agree to these Terms.
Please read them carefully.
1. Definitions of terms and conditions
- Client / You / Your: The person or business using our Website and Services.
- Service: All photo editing, retouching, manipulation, enhancement, and related work offered by Clarity Edit.
- Deliverables: Final edited images provided after payment.
- Order: Any request submitted via “Get A Quote,” forms, email, or website.
- Free Trial: Limited free service provided for evaluation before placing a paid order.
2. Acceptance of Terms
By using our Services, you confirm that:
- You are legally capable of entering into this agreement (i.e., you are of legal age or have parent/guardian consent if required in your jurisdiction).
- All information you provide is accurate
- You accept all policies linked in our footer (Privacy Policy, Refund Policy, etc.)
- If you do not agree, you may not use the Website or Services.
3. Services We Provide
Clarity Edit specializes in:
- Background Removal & Clipping Path
- Photo Retouching & Enhancement
- Color Correction
- Photo Restoration
- E-commerce Photo Editing
- Real Estate Photo Editing
- Beauty & Fashion Retouching
- Image Manipulation
- Other custom editing services
Service details, pricing, and delivery timelines will be provided after review of your images and instructions.
4. “Get A Quote” Terms
When using the “Get A Quote” feature:
1. You must provide accurate instructions and image samples.
2. We will respond with:
- Estimated price
- Expected delivery time
- Service details
3. A quote does not guarantee acceptance of your project.
4. Quotes may change if:
- Image quantity changes
- Complexity is higher than described
- Additional instructions are added
A project begins only after you confirm acceptance of the quote.
5. Orders & Requirements
When placing an order:
- Provide clear instructions and necessary files
- We review your Order to ensure feasibility, quality, and pricing.
- Ensure you own or have permission to use the images
- Ensure no illegal, harmful, or copyrighted content is submitted without rights
- Once the Order is confirmed, we begin work according to your specifications.
We may reject any order that violates our guidelines.
6. Revisions
Each Order includes the revision rights stated in the applicable plan, quote, or Order confirmation. Revision requests must relate to the Original Brief and be submitted during the agreed review period.
If no review period is stated, revision feedback must be submitted within 7 calendar days of the relevant Delivery.
Where a plan expressly offers “unlimited revisions,” this means reasonable and specific, in-scope revision requests submitted during the stated review period. It does not include new concepts, additional services, repeated changes of direction, or an indefinite obligation to continue work.
New instructions or material scope changes may require a revised quote.
7. Payments
The payment amount, currency, due date, accepted payment method, and any deposit or milestone requirements will be stated in the applicable quote, invoice, or Order confirmation.
Payment must be made using the instructions provided in that document. Unless otherwise agreed in writing, full payment is required before Clarity Edit releases full-resolution, watermark-free Deliverables.
For large or staged projects, Clarity Edit may require an advance deposit or milestone payments, but only where stated in the applicable quote, invoice, or Order confirmation.
If a payment is overdue, Clarity Edit may pause work or withhold undelivered Deliverables until payment is received. Any cancellation or refund will be handled under the Refund and Cancellation Policy, without limiting mandatory legal rights.
We reserve the right to refuse future work from clients who repeatedly delay or dispute payments.
8. Free Trial Terms
Clarity Edit may offer a Free Trial to new clients so they can evaluate our work quality.
8.1 Free Trial Eligibility
- Only available for first-time clients
- Number of trial images is limited
- Certain services may not be included in the trial
8.2 Free Trial Deliverables
Free Trial images will always be delivered:
- With visible watermarks, or
- In low resolution, or
- In both formats
These files are for preview only, not for commercial or personal use.
8.3 Restrictions
You may NOT:
- Remove or crop watermarks
- Use trial images in any form
- Publish or print trial results
- Claim or distribute the trial work
Unauthorized use may result in legal action.
8.4 Final Files After Payment
You will receive:
- High-resolution images
- Watermark-free results
- Final editable files (if included)
ONLY after full payment is received.
8.5 Using Trial Images for Portfolio or Marketing
We will NOT use your trial images for portfolio or marketing unless you give written permission.
If permission is not granted → Your images remain private.
9. Delivery
Delays caused by events beyond Clarity Edit’s reasonable control do not automatically create liability for indirect or consequential loss. However, if Clarity Edit cannot complete the affected service within a reasonable revised timeframe, the client may cancel and receive a refund for the uncompleted portion under the Refund and Cancellation Policy. Mandatory legal rights remain unaffected.
10. Refund and Cancellation Terms
All cancellations, revisions, service-quality concerns, and refunds are governed by the Refund and Cancellation Policy available at:

In summary:
- Cancellation before Work Starts qualifies for a full refund;
- Cancellation after Work Starts qualifies for a pro-rata refund for the uncompleted portion;
- No additional cancellation fee applies;
- After Delivery, the agreed revision process will normally be used first;
- A verified duplicate payment will be refunded in full; and
- A material service failure that cannot be corrected may qualify for a partial or full refund.
This summary does not limit the complete Refund and Cancellation Policy or any mandatory statutory right.
11. Intellectual Property Rights
11.1 Your Rights
- You retain full ownership of your original images
- You confirm you have permission to use and edit these images
11.2 License You Grant Us
When uploading images, you grant us permission to:
- Edit
- Manipulate
- Process
- Deliver final versions
Only for fulfilling your order.
11.3 Portfolio and Marketing Use
We will not publish or use identifiable client images, Deliverables, private project files, or testimonials for portfolio, advertising, or other promotional purposes without the client’s separate prior written permission.
Any permission request will identify the material and intended use. Refusing permission will not affect the requested Services.
The client may withdraw permission for future use by contacting us. We will take reasonable steps to stop future use and remove the material from locations under our control. Withdrawal does not affect use that was lawful before withdrawal and may not remove copies already printed, shared, indexed, or stored by independent third parties.
12. Confidentiality
We treat client images, project files, instructions, and related confidential information as confidential.
Access is limited to authorised Clarity Edit staff and local contractors in Bangladesh who need the information to review, edit, quality-check, deliver, or support an Order. Staff and contractors are subject to confidentiality and data-handling obligations and may not use client files for their own purposes.
We may also use technology and business service providers for website hosting, security, email, file storage, backup or transfer, form processing, invoicing, record management, payment or banking services, and other functions reasonably necessary to operate the Services. These providers may process only the information necessary to provide their relevant service.
We may disclose relevant information where required by law or valid legal process, or where reasonably necessary to protect legal rights, prevent fraud or serious misuse, resolve a dispute, or establish, exercise, or defend a legal claim.
We do not rent, trade, or sell client contact details or project files. Further information about access, service providers, international processing, retention, and security is provided in our Privacy Policy.
13. Acceptable Use
You must ensure that any image you upload is either owned by you or that you have the legal rights to upload, edit, and use it.
You agree not to:
- Upload illegal or offensive content
- Use our work for unlawful purposes
- Violate copyright laws
- Exploit Free Trials in abusive ways
We reserve the right to deny service if terms are violated.
14. Disclaimers & Limitation of Liability
“As Is” Service: The Service is provided “as is” and “as available.” We do not guarantee perfection, although we strive for high quality.
No Warranty: We don’t guarantee that the results will be error-free, that the website will be completely secure, or that the delivery timeline will always be met.
Clarity Edit is not responsible for:
- Loss of data
- Loss of profit
- Business disruption
- Delays beyond our control
- Client misuse of edited images
Our maximum liability is limited to the amount paid for the Service.
15. Termination
We may suspend or terminate your access to the Service if:
- You violate these Terms
- You misuse Free Trials
- You behave abusively
Termination does not remove your payment obligations.
16. Updates to These Terms
Changes to these Terms apply prospectively from their stated effective date. The version accepted when an Order was placed will continue to govern that Order unless a change is required by law or agreed in writing by both parties.
17. Governing Law and Disputes
These Terms are governed by the laws of Bangladesh.
This choice of law does not deprive an eligible consumer of mandatory protections available under applicable law in the consumer’s country or region.
Before commencing formal proceedings, the parties should first attempt to resolve the matter through good-faith written discussion. Mediation or arbitration will apply only where both parties agree in writing or applicable law requires it. Unresolved disputes may be submitted to a court of competent jurisdiction.
18. Severability
If any part of these Terms is found to be invalid or unenforceable, that part will be limited or removed, and the rest of the Terms will remain in force.
